Incapacity planning,
while signing is simple.
Incapacity is the planning subject most families avoid the longest. It is also the subject where the cost of avoidance is highest, because the document that prevents a Tennessee conservatorship cannot be signed once it is needed.

What happens without a plan.
When a Tennessee resident becomes incapacitated without a durable power of attorney and a healthcare directive in place, the family's only path is conservatorship. They petition the chancery court to appoint a conservator, who then has legal authority to make decisions for the protected person.
Conservatorship is a serious deprivation. The protected person loses, by court order, the right to make their own financial and medical decisions. The court reviews the conservator's actions annually. The process is public. The cost is real.

What conservatorship looks like in Tennessee.
The petition.
A family member files a petition in chancery court. A guardian ad litem is appointed to represent the protected person's interests. The respondent is examined by a physician. A hearing is scheduled.
The hearing.
Often six to eight weeks after the petition. The court reviews evidence of incapacity and the proposed conservator's suitability. If the family is in agreement, the hearing may be brief. If not, it can be contested at length.
Annual reporting.
The conservator files annual accountings with the court. Significant transactions require court approval. The supervision is appropriate, but it is also expensive and slow.
Total cost for a routine conservatorship is commonly several thousand dollars, plus annual maintenance. A contested case can run much higher.

The four-document plan that prevents it.
Durable financial power of attorney.
Names an agent to handle financial and legal matters. Survives incapacity. Drafted to be accepted by banks, title companies, and brokerages.
Healthcare power of attorney.
Names an agent to make medical decisions when you cannot. Distinct from the financial POA. Often a different person.
Living will.
Records your specific end-of-life wishes, so the healthcare agent has written direction rather than guesswork.
HIPAA release.
Permits your agents and family to access medical records they will need to make the decisions the documents authorize.
These four documents, properly drafted and properly executed, prevent the conservatorship filing in nearly every case. They cost a fraction of the alternative, and they preserve dignity.
The four-document plan is signed in a single afternoon, and prevents the most painful court process most Tennessee families ever face.

Adding trust-based continuity.
A revocable living trust adds an additional layer for trust assets. The successor trustee you named takes over management of trust property without any court involvement, on the same incapacity standard the trust defines.
Combined with the four-document plan, the trust handles incapacity continuity for the bulk of the household balance sheet without anyone applying to a court.

Planning specifically for dementia.
Dementia is the most common reason these documents become necessary, and the most common reason they are signed too late. Capacity erodes gradually. The window during which a person can lawfully sign a power of attorney closes earlier than families expect.
If a parent has received an early diagnosis, the right step is to sign the documents now, while capacity is intact. Document the signing carefully, with witnesses, with the attorney's contemporaneous notes. We handle this work routinely and respectfully.
